On October 4, 1958, plaintiffs, James A. Stevenson and his wife, Dolores, brought an action for damages against Jeanette Barwineck and three partners d/b/a Louis Levings & Sons. Defendants Barwineck and Levings filed separate answers and defendants Levings moved for summary judgment. The circuit court denied the motion, and defendants Levings appealed.
